Orceo vs. COMELEC, G.R. No. 190779 partially granted the petition. The Decision was received on April 15, 2010. The dispositive portion of which reads as follows: WHEREFORE, the petition is PARTLY GRANTED insofar as the exclusion of replicas and imitations of airsoft guns from the term “firearm” is concerned. Replicas and imitations of airsoft guns and airguns are hereby declared excluded from the term “firearm” in Resolution No. 8714. The petition is DISMISSED in regard to the exclusion of airsoft guns from the term “firearm” in Resolution No. 8714. Airsoft guns and airguns are covered by the gun ban during the election period.
